- (1) Following any period of institutional control needed to meet the requirements found necessary under Rule 0400-20-11-.09, the licensee may apply for an amendment to terminate the license.
- (2) This application must be filed, and will be reviewed, in accordance with the provisions of paragraphs (7) and (8) of Rule 0400-20-11-.08.
(3) A license is terminated only when the Department finds:
- (a) That the institutional control requirements found necessary under subparagraph (1)(g) of Rule 0400-20-11-.09 have been met;
- (b) That any additional requirements resulting from new information developed during the institutional control period have been met, and that permanent monuments or markers warning against intrusion have been installed; and
- (c) That the records required by subparagraphs (1)(e) and (f) of Rule 0400-20-11-.19 have been sent to the party responsible for institutional control of the disposal site and a copy has been sent to the Division immediately prior to license termination.
