1. (1) Following any period of institutional control needed to meet the requirements found necessary under Rule 0400-20-11-.09, the licensee may apply for an amendment to terminate the license.
2. (2) This application must be filed, and will be reviewed, in accordance with the provisions of paragraphs (7) and (8) of Rule 0400-20-11-.08.

3. (3) A license is terminated only when the Department finds:

   1. (a) That the institutional control requirements found necessary under subparagraph (1)(g) of Rule 0400-20-11-.09 have been met;
   2. (b) That any additional requirements resulting from new information developed during the institutional control period have been met, and that permanent monuments or markers warning against intrusion have been installed; and
   3. (c) That the records required by subparagraphs (1)(e) and (f) of Rule 0400-20-11-.19 have been sent to the party responsible for institutional control of the disposal site and a copy has been sent to the Division immediately prior to license termination.
