1. (1) This rule and Schedule RHS 8-33 concern low level radioactive waste and are to:

   1. (a) Control transfers of low-level radioactive waste by any waste generator, waste collector or waste processor licensee, as defined in Schedule RHS 8-33 of Rule 0400-20-05- .161, who ships low-level waste either directly, or indirectly through a waste collector or waste processor, to a licensed low-level waste land disposal facility as defined in Chapter 0400-20-11.
   2. (b) Establish a manifest tracking system; and
   3. (c) Supplement existing requirements concerning transfers and recordkeeping for those wastes.
2. (2) Any licensee shipping radioactive waste intended for ultimate disposal at a licensed land disposal facility shall document the information required on U.S. NRC Uniform Low-Level Radioactive Waste Manifest and transfer this recorded manifest information to the intended consignee as specified in Section I of Schedule RHS 8-33.
3. (3) Each shipment manifest shall include a certification by the waste generator as specified in Section II of Schedule RHS 8-33.
4. (4) The waste generator, collector, processor, disposal facility operator, and each person involved in the transfer and disposal shall comply with the requirements specified in Section III of Schedule RHS 8-33.
5. (5) Any licensee shipping byproduct material as defined in subparagraphs (c) and (d) of the definition of Byproduct material set forth in Rule 0400-20-05-.32 intended for ultimate disposal at a land disposal facility licensed under Chapter 0400-20-11 shall document the information required on the NRC’s Uniform Low-Level Radioactive Waste Manifest and transfer this recorded manifest information to the intended consignee as specified in Schedule RHS 8-33.
