Any hospital licensed pursuant to chapter 34-12 shall annually report charge information to the South Dakota Association of Healthcare Organizations for which that hospital had at least ten cases during the twelve months preceding the report, using the hospital's All Patient Refined Diagnosis-Related Groups or the Medicare Severity Diagnosis Related Groups. The Department of Health shall promulgate rules pursuant to chapter 1-26 to provide for the reporting of charge information by hospitals. The rules must include the method for hospitals to report charges, and standards for the validity and comparability of reported charges. For the purposes of this section, "charge information" means:

1. (1) The number of discharges;
2. (2) The average length of stay;
3. (3) The average charge;
4. (4) The median charge;
5. (5) Demographic information;
6. (6) Payer mix;
7. (7) Charges not paid;
8. (8) Charges paid by medicare, medicaid, other governmental programs, and private insurance; and
9. (9) Uncompensated care.
