Owners or operators of an AST which cannot comply with the requirements of § 74:56:03:05 may request a variance from the department by submitting justification for the variance. Criteria considered in granting variances include adverse impacts to the operation of the AST system, potential for damage to the structural integrity of the AST system, and other similar factors which may limit the performance of internal inspections.
