Each report required by a permit and other information requested by the secretary must be signed by a person described in 40 C.F.R. § 403.12 (July 1, 2016). A person is a duly authorized representative only under the following circumstances:

1. (1) The authorization is made in writing by a person described in 40 C.F.R. § 403.12(1) (July 1, 2016);
2. (2) The authorization specified either an individual or a position with responsibility for the overall operation of the regulated facility or activity, such as the position of plant manager, or superintendent, a position of equivalent responsibility, or an individual or position with overall responsibility for environmental matters for the company; and
3. (3) The written authorization is submitted to the secretary.
