The final permit decision is effective 30 days after the service of notice of the decision except under the following circumstances:

1. (1) A later effective date is specified in the decision;
2. (2) A hearing is requested under § 74:52:05:15; or
3. (3) No comments or requests for changes in the proposed permit were received during the public notice period, in which case the permit is effective upon receipt by the applicant of the final permit decision.
