A facility with a currently effective EPA-issued NPDES permit must submit a new application for an SWD permit at least 180 days before the expiration date of the existing permit, unless permission for a later date has been granted by the secretary. The secretary may grant permission to submit an application later than the deadline but in no case may the application be submitted later than the expiration date of the existing permit.
