The standards of performance for volatile organic liquid storage vessels including petroleum liquid storage vessels for which construction, reconstruction, or modification commenced after October 4, 2023, are those in New Source Performance Standards Review for Volatile Organic Liquid Storage Vessels (IncludingPetroleumLiquidStorageVessels), 89 Fed. Reg. 83,319-83,336 (October 14, 2024) (to be codified at 40 C.F.R. Part 60, Subpart Kc). A source that operates a unit subject to Subpart Kc is exempt from the obligation to obtain a Part 70 operating permit if the unit is not required to install controls and if the source is not required to obtain a Part 70 operating permit for a reason other than the source is subject to Subpart Kc. Exempted sources must still meet the applicable requirements in Subpart Kc.
