74 : 36 : 07 : 146 . Standards of performance for new municipal solid waste landfills. The standards of performance for municipal solid waste landfills that commenced construction, reconstruction, or modification after July 17, 2014, are those in 40 C.F.R. Part 60 , Subpart XXX (July 1, 20 24 ). Physical or operational changes made to existing municipal solid waste landfills solely to comply with §§ 74:36:07:94 to 74:36:07:145 , inclusive, or activities required by or conducted pursuant to a CERCLA, RCRA, or state remedial action , are not considered construction, reconstruction, or modification for purposes of this section.
