The standards of performance for storage vessels for petroleum liquids for which construction, reconstruction, or modification commenced after June 11, 1973, and prior to May 19, 1978, are those in 40 C.F.R. Part 60, Subpart K (July 1, 2024). A source that operates a unit subject to Subpart K is exempt from the obligation to obtain a Part 70 operating permit if the unit is not required to install controls and if the source is not required to obtain a Part 70 operating permit for a reason other than the source is subject to Subpart K. Exempted sources must still meet the applicable requirements in Subpart K.
