74 : 36 : 07 : 109 . Existing municipal solid waste landfill control system. The secretary must approve the control system if it meets one of the following requirements, except as provided in 40 C.F.R. § 60.24 (July 1, 20 24 ):
(3) An enclosed combustor designed and operated to either reduce nonmethane organic compounds by ninety-eight percent by weight or the outlet nonmethane organic compound concentration to twenty parts per million as hexane by volume, dry basis at three percent oxygen, or less.
The owner or operator must route the collected gas to a treatment system that processes the collected gas for subsequent sale or beneficial use or use as a raw material in a chemical manufacturing process. Venting of treated landfill gas to the ambient air is not permitted. If the treated landfill gas cannot be routed for subsequent sale or beneficial use, the treated landfill gas must be controlled according to subdivision (1), (2), or (3) of this section. All emissions from any atmospheric vent from the gas treatment system are subject to the requirements of §§ 74:36:07:106 and 74:36:07:107 or subdivision (1), (2), or (3) of this section. Atmospheric vents located on the condensate storage tank are not part of the treatment system and are exempt from the requirements of this subdivision.
If a boiler or process heater is used as a control device, the landfill gas stream must be introduced into the flame zone. The control device must be operated within the operating parameter ranges established during the initial or most recent performance test. For the closed landfill subcategory, the initial or most recent performance test conducted on or before July 17, 2014 satisfies the performance testing requirements.
