The secretary shall recommend to the board the issuance of general permits for the categories found in § 74:27:10:02. The secretary shall publish the recommendation that a general permit be issued in at least three newspapers of general circulation in the state and shall mail a copy of the notice and recommendation to all municipalities, counties, and tribal government in the state. The procedures for contested cases on general permits are those found in article 74:09 and chapter 74:27:08. If a petition for hearing is not filed on time, the recommendation of the secretary becomes the final decision on the general permit.
