In addition to the Tier 2 public notice categories found in 40 C.F.R. § 141.203(a), the department determines that the following violations and other situations require a Tier 2 public notice (ratherthanaTier3publicnotice):

1. (1) Failure to monitor or failure to report for either nitrate or nitrite or both; or
2. (2) Failure to monitor or failure to report for turbidity.
