The following entities are eligible to receive a state matching fund grant from the state highway fund if they have first received FTA or department approval for a federal transit grant listed in § 70:06:01:02:

1. (1) County government;
2. (2) City government;
3. (3) Indian tribal governments;
4. (4) Private nonprofit corporations; and
5. (5) State agencies.
