70: 03:01:07. Restrictions on time of movement -- Exceptions. Unless allowed in another section in this chapter, the following restrictions on time of movement apply to a permit issued according to this chapter.
(9) The permit vehicle will travel on state highways which are noninterstate and beyond a two-mile radius of an interstate highway interchange.
A permit issuing authority may place the daylight hours restriction on a permit if traffic, highway, or other conditions indicate the need for such a restriction.
In the best interest of public safety, a permit-issuing authority, with the concurrence of the secretary of the Department of Transportation or an authorized representative, may issue a permit to allow the movement of a permit vehicle anytime.
To facilitate the handling of a public emergency, a permit issuing authority may issue a permit to allow the movement of a permit vehicle anytime.
Movement is restricted to daylight hours if one or more of the following conditions exist:
