A recipient of temporary assistance to needy families may be eligible for child care assistance if:

1. (1) The parent is participating in an activity approved under chapter 67:10:06;
2. (2) The parent has a child who is less than 13 years of age or who has special needs; and

3. (3) The child:

   1. (a) Is on temporary assistance to needy families, would be a dependent child if needy, is receiving supplemental security income, or is receiving temporary assistance to needy families foster care; and
   2. (b) Resides with the parent.
