In order to meet the covered service conditions of subdivision 67:16:47:04(2), the state review team must determine that the following conditions exist:

1. (1) Outpatient services available in the community do not meet the individual's treatment needs; and
2. (2) Proper treatment of the individual's psychiatric condition requires services on an inpatient basis under the direction of a physician.
