1. (1) An individual shall participate in the primary care provider program if the individual is:

   1. (a) Covered under subdivision 67:46:01:02(1);
   2. (b) At least 19 years old and covered under subdivision 67:46:01:02(2);
   3. (c) Covered under subdivision 67:46:01:02(11) through (15);
   4. (d) Covered under subdivision 67:46:01:02(22); or
   5. (e) Covered under subdivision 67:46:01:02(26).
2. (2) If the individual qualifies under one of the subdivisions but is a recipient of home and community-based services, the individual is exempt from participating in the primary care provider program.
