An assistance unit is exempt from the monthly reporting requirements contained in § 67:12:06:34 if:

1. (1) The caretaker relative is not a member of the assistance unit and is not currently sanctioned for not cooperating with the department; and

2. (2) The members of the assistance unit have no earned income and have not received any earned income in the past two months.
