The per capita payments of Indian judgment funds made pursuant to the provisions of the Indian Tribal Judgment Funds Use or Distribution Act, Pub. L. No. 93-134, 87 Stat. 466 (1973), are excluded as income or resources when determining eligibility for, and the amount of, the aid to families with dependent children assistance payment. Payments received by the member as a result of the investment of the per capita judgment funds are considered income.
