Notwithstanding § 67:12:01:29, in unstable family situations where the absent parent is in and out of the home intermittently and does not function as the provider of maintenance or fails to provide physical care and guidance for the child on a relatively permanent and continuing basis, the child involved is considered deprived of parental support or care within the meaning of the Aid to Families With Dependent Children program.
