Time standards set by §§ 67:12:01:06 to 67:12:01:07, inclusive, apply when determining Aid to Families with Dependent Children (AFDC) eligibility or AFDC continuing eligibility for services. The time standards do not apply when circumstances beyond the control of the applicant, recipient, or the department prevent the department from reaching a prompt decision on AFDC eligibility or AFDC continuing eligibility. The department shall record the circumstances in the case record. The time standards for determining AFDC eligibility ot AFDC continuing eligibility may not be used as a waiting period before granting aid, or as a basis for denial of an application or for termination of assistance.
