44 : 90 : 09 : 02 . Absence of mandatory testing. The absence of mandatory testing may not be interpreted to allow:

1. (1) The use of prohibited solvents or pesticides;
2. (2) Agricultural or manufacturing practices that promote the growth of mold, yeast, or bacteria; or
3. (3) Soil or growing media containing unsafe levels of lead, arsenic, cadmium, or mercury.
