One bighorn sheep license shall be allocated as an auction license in § 41:06:56:03 if a minimum of three bighorn sheep licenses are approved by the commission. The commission shall determine in which unit or units the auction license is valid. The auction license made available to a successful bidder at an auction to be conducted by a nonprofit organization organized for and devoted to providing big game management, preservation, propagation, habitat, and research and recognized as an exempt organization under § 501(c)(3) of the United States Internal Revenue Code.
