The tundra swan hunting season is open from the Saturday closest to October first through the end of the light goose hunting season as established in § 41:06:16:07 in the counties of Aurora, Brule, Beadle, Brookings, Brown, Buffalo, Campbell, Clark, Codington, Davison, Day, Deuel, Edmunds, Faulk, Grant, Hand, Hamlin, Hanson, Hughes, Hyde, Jerauld, Kingsbury, Lake, Marshall, McCook, McPherson, Miner, Minnehaha, Moody, Potter, Roberts, Sanborn, Spink, Sully, and Walworth. No more than one thousand three hundred permits may be issued with one tag per permit. No more than two hundred of the available permits may be issued to nonresidents. Hours for shooting tundra swans are the same as for shooting ducks.
A person may not hunt a tundra swan unless the person has been issued a license. The license is valid for the taking of one tundra swan. Each swan must be tagged immediately upon retrieval in accordance with § 41:06:03:01 or 41:06:03:01.01.
Land occupant preference is not applicable to the tundra swan season. If permits remain unsold after the first lottery drawing, only those residents and nonresidents who do not have a permit may apply in the second lottery drawing for, and receive one permit from, any remaining resident and nonresident permits, respectively. If any resident and nonresident permits remain unsold after the second lottery drawing, all permits must be combined and any resident or nonresident may receive a permit. No person may receive more than two permits.
