24 : 28 : 09 : 11 . Performing artist permit employer requirements. If an offer of employment is accepted by someone who is qualified to teach pursuant to § 24:28:09:09 but is not a certified educator, the employing school district or d epartment-accredited school must state on the intent to employ form provided to the applicant for submission with their application :

1. (1) That the school is unable to hire a certified educator to fill the vacancy;
2. (2) The position to be held by the applicant; and
3. (3) The name of the certified teacher who will serve as a mentor to the applicant.
