22 : 03 : 01 : 09 . Agreement between delivery agent and participating register of deeds. The delivery agent and participating register of deeds shall enter into an agreement specifying the requirements, terms, and conditions of participation in the participating register of deed's electronic recording program and delivery system. At a minimum, the agreement shall address the following items:

1. (1) Accepted electronic recording models;
2. (2) Accepted document types;
3. (3) Technical specifications for data formats, document formats, electonic transmissions, and security;
4. (4) If used by the participating register of deeds, indexing fields required for each document code;
5. (5) Electronic signature and notarization requirements;
6. (6) Payment of fees;
7. (7) Hours during which electronic submissions shall be accepted and processing schedules that affect order of acceptance;
8. (8) Document acceptance and rejection requirements and procedures; and
9. (9) Termination terms.
