An agent, including the developer if it is also the agent, may not sell or offer to sell an interest in a time-share plan for a developer if the time-share unit is located in the state whether the sale or offer for sale is made in the state or out-of-state, unless the agent files and the commission accepts the following:

1. (1) The time-share plan or plans it intends to sell;
2. (2) Its principal office address and telephone number;
3. (3) If a corporation, the name, address, and telephone number of its responsible managing employee; and
4. (4) A copy of the special escrow agreement as required by § 20:69:12:28.
