The board may not issue a license to conduct a remote pharmacy to any pharmacist applicant unless the pharmacist applicant is an owner, or part owner, of the place of business from which the pharmacist will practice telepharmacy, or unless the non-pharmacist owner of the place of business from which the pharmacist will practice telepharmacy files an affidavit outlined in SDCL subdivision 36-11-34(3) for the license year ending June thirtieth.
