A licensed practical nurse, registered nurse, or advanced practice registered nurse may delegate nursing tasks, in accordance with §§ 20:48:04.01:01 and 20:48:04.01:02, to an individual in a nursing facility, if the individual:

1. (1) Is registered with the board as a certified nurse aide in accordance with chapter 20:48:16; or
2. (2) Has worked less than four months in the nursing facility and is enrolled as a student in a board-approved nurse aide training program or has completed the program and is awaiting registration by the board as a certified nurse aide.
