A party may request mediation by the commission at any point during negotiations held pursuant to SDCL 49-31-81. Any party to the negotiation may file a joint request for mediation. A mediation request shall be in writing and shall include the following information:

1. (1) The identity of each party to the negotiation, including the name, address, and telephone and facsimile numbers of each party or the party's representative;
2. (2) The date on which the request for negotiation was made;
3. (3) A list of the issues to be mediated; and

4. (4) A proposed time schedule for the mediation, including a date by which the mediation must be terminated if an agreement is not reached.

   The party requesting mediation shall serve the request on each party to the negotiation.
