Under the following conditions, the executive secretary may instruct the bookkeeper to withhold payment of any portion of the purse of a race until the matter is resolved:

1. (1) If the official order of finish of a race has been appealed pursuant to § 20:04:28:22;
2. (2) If the director has evidence to believe that the outcome of a race may have been influenced by methods that are prohibited under this article or SDCL 42-7-56; or

3. (3) If a hearing or investigation is pending.

   If a foul is reported to the steward, the purse and rider's fee may be withheld pending appeal to the commission.
