A Class A violation includes the following:
- (1) Conviction of a misdemeanor involving moral turpitude or a felony;
- (2) A deliberate misstatement, deliberate omission, misrepresentation, or untruth made in an application or during the background check that was not discovered before the license was granted;
- (3) Refusal to allow access to premises or records under this chapter;
- (4) Failure to pay a fine imposed by the board of stewards or the commission by the deadline established in the ruling or order imposing the fine; and
- (5) Failure by a licensee to pay a winning pari-mutuel ticket or failure by a multi-jurisdictional totalizator hub to allow a customer to withdraw funds from the customer's account within the time frame established in the hub's operating plan as approved by the commission.
