Contents of report form for alleged pesticide incident.

The report form required by SDCL 38-21-46 must include:
- (1) The name and address of person making the report;
- (2) The telephone number of person making the report;
- (3) The county and legal description of the property on which the incident occurred or damage is alleged;
- (4) The date, approximate time, weather conditions including wind direction, and temperature when the application was made, if known;
- (5) The county and legal description of the property on which the application was made;
- (6) The operator of the property on which the application was made;
- (7) A description of the incident or damages;
- (8) The name of the applicator or operator who applied the pesticides;
- (9) The name of any witness, if known;
- (10) Whether ground or aerial application was used and the crop that was treated;
- (11) The chemical used, if known;
- (12) Whether the applicator was notified and, if so, when; and
- (13) The date that the incident form was submitted and the signature of the person completing the form.
