1. A. Section 414 of the Multi-employer Pension Plan Amendments Act of 1980 (PL 96-364) provides for the reduction of unemployment benefits by pension payments on a pro-rata basis and notwithstanding Section 41-27-370, South Carolina Code of Laws, 1976, as amended, that in the event an individual has participated in any pension, retirement or retired pay, annuity or other similar plan of the base period employers by having made contributions to such plan, the weekly benefit amount payable to such individual for such week shall be reduced but not below zero,

   1. 1. by the prorated weekly amount of the pension after deductions of that portion of the pension that is directly attributable to the percentage of the contributions made to the plan by such individual;
   2. 2. by no part of the pension if the entire contributions to the plan were provided by such individual, or by the individual and an employer or any other person or organization who is not a base period employer; or
   3. 3. by the entire prorated weekly amount of the pension if Item 1 or Item 2 of this regulation does not apply.
