1. (1) a summary offense shall be sentenced to pay a fine of $500 and may be sentenced to a term of imprisonment not to exceed 90 days or both; or

2. (2) a misdemeanor shall be sentenced to pay a fine of $2,500 and may be sentenced to a term of imprisonment not to exceed one year or both.

   2004 Unconstitutionality. Act 230 of 2002 was declared unconstitutional. City of Philadelphia v. Commonwealth, 838 A.2d 566 (Pa. 2003).

For the purpose of this subchapter, any person or corporation convicted of:
