(a) Scope of section.— This section applies to an individual in a township if all of the following circumstances exist:

1. (1) The individual is elected or appointed a constable.
2. (2) The individual has a freehold estate worth at least $1,000.

3. (3) The individual fails to:

   1. (i) serve; or
   2. (ii) appoint a deputy to serve.

(c) Exception.— Subsection (b) shall not apply to an individual who:

1. (1) has served personally or by deputy in the office of constable of the same township within 15 years of election or appointment; or
2. (2) has paid a fine under subsection (b) within 15 years of election or appointment.
