The racing secretary shall exclusively use the following types of races:

1. (1) Stakes and futurities.
2. (2) Early closing and late closing events.

3. (3) Conditioned races. These qualifications may be based upon, among other things:

   1. (i) Horse’s money winnings in a specified number of previous races or during a specified previous time.
   2. (ii) A horse’s finishing position in a specified number of previous races or during a specified period of time.
   3. (iii) Age.
   4. (iv) Sex.
   5. (v) Number of starts during a specified period of time.
   6. (vi) Or any one or more combinations of the qualifications herein listed.

5. (5) Open races or invitational races.
