A confidential registration may be issued only to:

1. (1) A governmental law enforcement agency for a vehicle used to any extent for undercover or surveillance purposes; and
2. (2) Commonwealth departments and other agencies for vehicles assigned to Department secretaries and deputy secretaries and heads of other agencies.
