1. (a) A PRS agency shall determine an individual’s eligibility for continued stay during an IRP update required under § 5230.62(c) (relating to individual rehabilitation plan).

2. (b) An individual’s eligibility for continued stay shall be determined by documentation of the following:

   1. (1) An individual chooses continued participation in the PRS.

   2. (2) A continued need for service based upon one or both of the following:

      1. (i) As a result of a diagnosed mental, behavioral or emotional disorder, there is a functional impairment that is addressed in the IRP.
      2. (ii) The withdrawal of service could result in loss of rehabilitation gain or goal attained by an individual.
