1. (a) The county mental health and intellectual disability program shall submit a written request for waiver to the Secretary of the Department of Human Services, with a copy of the request for waiver to the Deputy Secretary, Office of Developmental Programs and the Deputy Secretary, Office of Mental Health and Substance Abuse Services.

2. (b) A request for waiver shall include the following:

   1. (1) The service for which the waiver is requested.
   2. (2) The fiscal year for which the waiver is requested.
   3. (3) Justification for the waiver.
   4. (4) The total expenditure by the county mental health and intellectual disability program for the service in the previous and current fiscal years.
   5. (5) Clients and units of service for the previous and current fiscal years.
