55 Pa. Code § 4210.41a – Clarification of contracted purchase of service—statement of policy.

(a) A ‘‘purchase of service agreement’’ under § 4210.41(b) (relating to description) means a written agreement for a contracted service to be provided to a county by a service provider. The term does not include per diem employment agreements between a county mental health program and a qualified professional regarding the issuance of warrants for involuntary emergency evaluation and treatment under section 302 of the Mental Health Procedures Act (50 P.S. § 7302) for involuntary commitment for emergency detention.
(b) As used in this section, the term ‘‘qualified professional’’ shall have the meaning given to it in section 103.1 of the Mental Health Procedures Act (50 P.S. § 7103.1).
