55 Pa. Code § 3800.2 – Applicability.

(a) This chapter applies to child residential facilities and child day treatment centers, except as provided in § 3800.3 (relating to exemptions).
(b) This chapter contains the minimum requirements that shall be met to obtain a certificate of compliance to provide child residential care or child day treatment in this Commonwealth.
(c) This chapter applies equally to profit, nonprofit, publicly funded, privately funded, church operated and nonchurch operated facilities.
(d) This chapter applies to the following:
1. (1) Any premise or part thereof, operated in a 24-hour living setting in which care is provided for one or more children who are not relatives of the facility operator, except as provided in § 3800.3.
2. (2) Child residential facilities that are either secure or nonsecure settings, including child detention centers.
3. (3) Child residential facilities that are located in a fixed structure, are mobile or any combination of fixed and mobile settings.
4. (4) Child day treatment centers.
5. (5) Transitional living facilities with more than one transitional living residence in the same building.
6. (6) Facilities serving children with disabilities, that serve exclusively children.
