1. (a) A family’s eligibility and payment for subsidized child care continues during a break in or following the loss of work, education or training for the remainder of the child’s current 12-month eligibility period.
2. (b) A child’s eligibility and payment for subsidized child care continues for the remainder of the child’s current 12-month eligibility period when there is a change in the child’s primary parent or caretaker. The substitute caretaker must meet only the requirement that the family’s annual income does not exceed 85% of the SMI.

3. (c) Subsidized child care will continue at the same level until the family’s next scheduled annual redetermination, unless one of the following situations occurs:

   1. (1) The family’s income exceeds 85% of the SMI.
   2. (2) The provisions specified in § 3042.22 (relating to subsidy termination) apply.
   3. (3) The provisions specified in § 3042.86 (relating to change reporting and processing) apply.
