(b) Notices. A nursing facility receiving a grant shall notify the Department in writing within 5 days of any of the following occurrences:

1. (1) The resident dies.
2. (2) The resident ceases to be MA eligible.
3. (3) The resident is transferred or discharged from the nursing facility, whether or not there is intent to return.
4. (4) The nursing facility determines, or is advised by the resident’s attending physician, that the exceptional DME is no longer medically necessary.
5. (5) The resident notifies the nursing facility in writing that he exercises his right to refuse use of the exceptional DME.
6. (6) The nursing facility ceases to use the exceptional DME or make that DME available to the resident in the course of providing nursing facility services to the resident.
