Payment for child care will be made when the child care arrangements are as follows:

1. (1) The person or entity providing child care meets the following conditions:

   1. (i) Provides care in accordance with applicable standards of Federal, State and local law.
   2. (ii) Allows parental access to the child while the child is in care without the need for prior notification.
   3. (iii) Is a person who is at least 18 years of age.

2. (2) The person or entity providing child care may not be one of the following:

   1. (i) The biological or adoptive parent or legal guardian of the child.
   2. (ii) A member of the TANF budget group.
   3. (iii) The stepparent of the child living in the home.
