1. (a) Qualified instructors. A real estate education provider shall employ instructors who are qualified to teach the courses for which the instructors have been hired. The real estate education provider may consider an individual qualified to teach a course if the individual satisfies one of the following criteria:

   1. (1) Possesses an undergraduate, graduate or postgraduate degree in the subject matter of the course to be taught.
   2. (2) Has 3 years of practical or teaching experience in a profession, trade or occupation directly related to the subject matter of the course to be taught.
2. (b) Proof of qualifications. A real estate education provider shall maintain documentation substantiating the instructor’s education and experience.
