The following words and terms, when used in this part, have the following meanings, unless the context clearly indicates otherwise:

Chairperson—The Chairperson of the Commission.

Commission—The Navigation Commission for the Delaware River and its navigable tributaries.

Department—The Department of State of the Commonwealth.

Navigable tributaries—Tidal portions of the navigable tributaries are defined as follows:

1. (i) Schuylkill River below Fairmount Dam.
2. (ii) Chester Creek below Ninth Street.
3. (iii) Crum Creek below Route 291 (Industrial Highway) bridge.
4. (iv) Darby Creek below 84th Street.
5. (v) Neshaminy Creek below Route 13 bridge.
6. (vi) Pennypack Creek below Frankford Avenue Bridge.

7. (vii) Ridley Creek below Baltimore and Ohio Railroad Bridge in Chester.

   River—Tidal portions of the Delaware River, from the Delaware border in the South to the Railroad Bridge at Morrisville in the North, and its navigable tributaries within this Commonwealth.

   Secretary—The Secretary of the Commonwealth.
