4 Pa. Code § 167.122
(a) As set forth in 57 Pa.C.S. § 323(a)(3) (relating to sanctions), the department may deny, refuse to renew, revoke, suspend, reprimand or impose a condition on a commission as a notary public for conviction of or acceptance of accelerated rehabilitative disposition by the applicant or notary public of an offense involving fraud, dishonesty or deceit. An offense involving fraud, dishonesty or deceit includes any of the following:
(1) The following offenses defined in 18 Pa.C.S. Chapter 39, Subchapter B (relating to definition of offenses):
Section 3921 (relating to theft by unlawful taking or disposition).
Section 3922 (relating to theft by deception).
Section 3922.1 (relating to financial exploitation of an older adult or care-dependent person).
Section 3923 (relating to theft by extortion).
Section 3924 (relating to theft of property lost, mislaid, or delivered by mistake).
Section 3925 (relating to receiving stolen property).
Section 3926 (relating to theft of services).
Section 3927 (relating to theft by failure to make required disposition of funds received).
Section 3929 (relating to retail theft).
Section 3929.1 (relating to library theft).
Section 3929.3 (relating to organized retail theft).
Section 3930 (relating to theft of trade secrets).
Section 3931 (relating to theft of unpublished dramas and musical compositions).
Section 3932 (relating to theft of leased property).
Section 3934 (relating to theft from a motor vehicle).
Section 3935.1 (relating to theft of secondary metal).
Section 3936 (relating to theft of mail).
(2) The following offenses defined in 18 Pa.C.S. Chapter 41 (relating to forgery and fraudulent practices):
Section 4101 (relating to forgery).
Section 4101.1 (relating to digital forgery).
Section 4102 (relating to simulating objects of antiquity, rarity, etc.).
Section 4103 (relating to fraudulent destruction, removal or concealment of recordable instruments).
Section 4104 (relating to tampering with records or identification).
Section 4105 (relating to bad checks).
Section 4106 (relating to access device fraud).
Section 4106.1 (relating to unlawful device-making equipment).
Section 4107 (relating to deceptive or fraudulent business practices).
Section 4107.1 (relating to deception relating to kosher food products).
Section 4107.2 (relating to deception relating to certification of minority business enterprise or women’s business enterprise).
Section 4108 (relating to commercial bribery and breach of duty to act disinterestedly).
Section 4109 (relating to rigging publicly exhibited contest).
Section 4110 (relating to defrauding secured creditors).
Section 4111 (relating to fraud in insolvency).
Section 4112 (relating to receiving deposits in a failing financial institution).
Section 4113 (relating to misapplication of entrusted property and property of government or financial institutions).
Section 4114 (relating to securing execution of documents by deception).
Section 4115 (relating to falsely impersonating persons privately employed).
Section 4117 (relating to insurance fraud).
Section 4118 (relating to washing vehicle titles).
Section 4119 (relating to trademark counterfeiting).
Section 4120 (relating to identity theft).
Section 4121 (relating to possession and use of unlawful devices).
(3) The following offenses defined in 18 Pa.C.S. Chapter 47 (relating to bribery and corrupt influence):
Section 4701 (relating to bribery in official and political matters).
Section 4702 (relating to threats and other improper influence in official and political matters).
Section 4703 (relating to retaliation for past official action).
(4) The following offenses defined in 18 Pa.C.S. Chapter 49 (relating to falsification and intimidation):
Section 4902 (relating to perjury).
Section 4903 (relating to false swearing).
Section 4904 (relating to unsworn falsification to authorities).
Section 4905 (relating to false alarms to agencies of public safety).
Section 4906 (relating to false reports to law enforcement authorities).
Section 4906.1 (relating to false reports of child abuse).
Section 4909 (relating to witness or informant taking bribe).
Section 4910 (relating to tampering with or fabricating physical evidence).
Section 4911 (relating to tampering with public records or information).
Section 4912 (relating to impersonating a public servant).
Section 4913 (relating to impersonating a notary public or a holder of a professional or occupational license).
Section 4914 (relating to false identification to law enforcement authorities).
Section 4915.1 (relating to failure to comply with registration requirements).
Section 4915.2 (relating to failure to comply with 42 Pa.C.S. Ch. 97 Subch. I registration requirements).
Section 4952 (relating to intimidation of witnesses or victims).
Section 4958 (relating to intimidation, retaliation or obstruction in child abuse cases).
(5) The following offenses defined in 18 Pa.C.S. Chapter 51, Subchapter A (relating to definition of offenses generally):
Section 5101 (relating to obstructing administration of law or other governmental function).
Section 5105 (relating to hindering apprehension or prosecution).
Section 5107 (relating to aiding consummation of crime).
Section 5108 (relating to compounding).
Section 5111 (relating to dealing in proceeds of unlawful activities).
(6) The following offenses defined in 18 Pa.C.S. Chapter 53 (relating to abuse of office):
Section 5301 (relating to official oppression).
Section 5302 (relating to speculating or wagering on official action or information).
