1. (a) Applicant who does not hold a commission as a notary public. The requirements for the examination are set forth in 57 Pa.C.S. § 322(a) (relating to examination, basic education and continuing education). The following apply:

   1. (1) An applicant for appointment and commission as a notary public who does not hold a commission in this Commonwealth must pass an examination administered by the department or a professional testing organization under contract with the department.
   2. (2) An applicant who does not hold a commission as a notary public includes an applicant who never held a commission as a notary public and an applicant who previously held a commission as a notary public but whose commission has since expired.
2. (b) Administration of examination. An applicant may not take the examination prior to submission of and approval by the department of an application for appointment.

3. (c) Timing of examination.

   1. (1) Upon approval by the department of an application for appointment, an applicant will be authorized to take the examination for a period of 6 months.
   2. (2) An applicant may retake the examination within the 6-month period, but no more than one time per 24-hour period.

4. (d) Examination results.

   1. (1) An applicant shall attain a scaled score of 75 or higher to pass the examination.
   2. (2) Examination results are valid for a period of 1 year from the date of the examination.
